'Data Protection' Package: a historic agreement

On 15 December 2015, the Luxembourg Presidency of the Council of the European Union reached an informal agreement in trialogues with the European Parliament on the 'Data Protection' Package which will set out new European rules on privacy in the digital age.

The agreement reached by the Luxembourg Presidency will have to be confirmed at the level of the Council of the EU by the 28 Member States, and will be addressed by a Coreper meeting to be held before 21 December 2015.

The 'Data Protection' Package, under negotiation since the European Commission put forward the proposal in January 2012, includes a Regulation establishing the general framework for the protection of personal data and a Directive on the protection of personal data processed for the purpose of law enforcement.

Following the adoption of general approach on the Regulation in the JHA Council of June 2015 and the adoption of a general approach on the Directive in the JHA Council of October 2015, the co-legislators ─ the European Parliament and Council of the European Union acting under the Luxembourg Presidency ─ have been engaged in intense negotiations in order to reach an agreement before the end of 2015.

Félix Braz, Luxembourg's Minister for Justice and President of the Council, declared: 'It is a fundamental agreement with significant consequences. This reform not only strengthens the rights of citizens, but also adapts the rules to the digital age for companies, whilst reducing the administrative burden. They are ambitious and forward-looking texts. We can have full confidence in the result.'

EU security agency Enisa has released a new paper recommending that policy-makers promote “privacy friendly” services – a move that appears to set it at odds with British PM David Cameron. The UK leader pledged yesterday to ban the use of strong encryption in communications.


The European Network and Information Security Agency, to give it its full name, argued in its report that privacy is a “fundamental human right” according to the European Convention on Human Rights and the Universal Declaration of Human Rights.

Privacy-Enhancing Technologies (PETs) like encryption are an important technical means of fighting off challenges to privacy, Enisa said in its report, Privacy and Data Protection by Design – from policy to engineering.

In the resolution, approved by 483 votes to 98 with 65 abstentions, MEPs express serious concern over PRISM and other surveillance programmes, strongly condemn spying on EU representations and call on the US authorities to provide them with full information on these allegations without further delay.

 

Parliament also expresses grave concern about allegations that similar surveillance programmes are run by several EU member states, such as the UK, Sweden, The Netherlands, Germany and Poland. It urges them to examine whether those programmes are compatible with EU law.

 

Stronger data safeguards urgently needed

 

Parliament calls on EU countries to speed up their work on the whole data protection package and urges the Commission and the US authorities to resume negotiations on the data protection agreement without delay.

 

===> The final deal must ensure that EU citizens' access to the US judicial system is equal to that enjoyed by US citizens, it adds. <===

Europas Internet-Nutzer bekommen künftig mehr Kontrolle über ihre persönlichen Daten.


Die künftige europäische Datenschutzgrundverordnung soll erstmals europaweit ein einheitliches Datenschutzniveau schaffen und das Recht auf Privatsphäre stärken. Die Reform löst seit 20 Jahren geltendes Recht ab, das vor allem wegen der rasanten Entwicklung des Internets als nicht mehr zeitgemäß gilt.


Damals waren soziale Netzwerke wie Facebook ebenso wenig ein Massenphänomen wie das groß angelegte Sammeln von Verbraucherdaten durch weltweit agierende Internetkonzerne wie Google. Parallel wird im sogenannten Trilog aus Parlament, EU-Rat und Kommission auch über die Datenschutzrichtlinie verhandelt, die Vorgaben für Polizei und Justizbehörden beim Umgang mit Daten macht.

Les griefs sont lourds : accès et maintien frauduleux dans tout ou partie d'un système de traitement automatisé de données, collecte de données à caractère personnel par un moyen frauduleux, déloyal ou illicite, atteinte volontaire à l'intimité de la vie privée d'autrui, utilisation et la conservation d'enregistrements et de documents obtenus par le moyen d'une atteinte à l'intimité de la vie privée d'autrui et atteinte au secret des correspondances électroniques.

 

La Fédération entend connaître l'implication exacte des géants américains du Web comme Facebook ou Google dans l'espionnage généralisé mis en place par la NSA.

Die großflächige Überwachung des Internets durch Geheimdienste hat viele Netznutzer aufgeschreckt. Manch einer sucht nun nach Wegen, sich ein Stück Privatsphäre zurückzuholen – diskrete Suchmaschinen wie DuckDuckGo oderIxquick, die Nutzerdaten weder speichern noch vermarkten, verzeichnen stark gestiegene Zugriffszahlen. Die Ixquick-Macher wollen dieses Modell bald auch auf den E-Mail-Verkehr ausdehnen.

 

Eine Frage der Zeit wann die sich AUCH beugen müssen!!!

The US intelligence service may have placed bugs in European Union (EU) buildings as part of its PRISM spying program, it has emerged from documents released by whistle-blower Edward Snowden.

 

Documents seen by the German newspaper Spiegel suggest that not only were bugs installed in the EU's offices in Washington, but also that the building's computer network was infiltrated.

 

Through this, surveillance teams had the capability to listen to discussions in several offices belonging to the EU, as well as being able to access emails and documents on computers.
